Welcome to Omega-3 Index Test. These Terms of Service ("Terms") govern your use of the omega3index.com.au website (the "Site"), the purchase of our test kits, and the testing and reporting services we provide (collectively, the "Service").

By accessing the Site, placing an order, or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Site or the Service.

1. About us

Our at-home test kit is a Class IIa Medical Device registered with the Therapeutic Goods Administration (ARTG 526367). Sample analysis is performed through our partnership with Masdiag.

In these Terms, "we", "us" and "our" refer to Omega-3 Index Test (a service of Masdiag Pty Ltd). "You" and "your" refer to the person accessing the Site or using the Service.

2. What the Service includes

When you purchase a test from us, you receive:

  • A TGA-registered at-home dried blood spot (DBS) collection kit, posted to your nominated Australian address
  • Pre-paid postage to return your collected sample to our analytical partner
  • Laboratory analysis of your sample using accredited GC-FID methodology
  • A clinical-grade PDF report containing your Omega-3 Index (and, for the Plus Ratios, your Omega-6:3 Ratio, AA:EPA Ratio and Trans Fat Index; and for the Complete, individual fatty acids), interpreted against established reference ranges
  • Trend tracking across repeat tests on the same account

3. What the Service is NOT

The Service is an informational laboratory testing service. It is not a substitute for clinical care and does not constitute the practice of medicine. Specifically:

  • We do not diagnose any condition. The report provides measurements and reference ranges, not a diagnosis. Diagnosis requires a qualified healthcare professional considering your full clinical picture
  • We do not prescribe, recommend, or supply treatments or supplements. Any decisions about supplementation, medication, or other health interventions must be made by you in consultation with a qualified healthcare professional
  • We do not provide medical advice. Any general educational content on the Site is for information only and does not constitute medical advice. Always consult your GP, specialist, or other qualified healthcare professional for advice about your individual health situation
  • We are not a substitute for emergency care. If you are experiencing a medical emergency, call 000 (Australia) immediately
  • We do not screen for or detect any condition other than Omega-3 status 

4. Eligibility

To use the Service you must:

  • Be at least 18 years of age, or have the consent and supervision of a parent or legal guardian if you are under 18
  • Have a valid Australian postal address for kit delivery
  • Provide accurate, current, and complete information when ordering
  • Not be in the third trimester of pregnancy without first consulting your obstetrician or midwife (we recommend discussing any testing during pregnancy with your maternity care provider)

Parents or guardians purchasing a test for a child or young person under 18 are responsible for providing consent on the child's behalf, supervising sample collection where appropriate, and acting as the contact point for results.

5. Orders and payment

By placing an order, you make an offer to purchase the products in your cart at the prices and on the terms set out at checkout. We may accept or reject any order at our discretion (for example, if a product is out of stock, if we suspect fraud, or if delivery to your address is not possible). Your order is only accepted when we confirm dispatch.

All prices are in Australian Dollars (AUD) and include GST where applicable. We reserve the right to change pricing at any time, but changes will not affect orders already accepted.

Payment is processed at the time of order via Shopify Payments or another approved payment provider. We do not store full credit card details on our systems.

6. Discount codes

From time to time we offer discount codes. Each code has specific terms typically single-use per customer, may exclude certain products, cannot be combined with other offers, and may have an expiry date. Codes have no cash value and cannot be redeemed retrospectively against past orders.

7. Shipping and delivery

We offer free Australia-wide shipping on all orders, in both directions (outbound kit and inbound sample). Kits typically arrive within 2-4 business days of dispatch.

While we partner with Australia Post for reliable service, we are not responsible for delays caused by the postal carrier, severe weather, postal strikes, or factors outside our reasonable control. If your kit has not arrived within 7 business days, please contact us at hello@omega3index.com.au.

You are responsible for providing an accurate delivery address. If a kit is returned to us due to an incorrect or incomplete address, you may be charged the cost of re-shipping.

8. Sample collection, registration, and turnaround

Once your kit arrives, you are responsible for following the included collection instructions carefully and registering your sample at the laboratory portal (currently at portal.masdiag.com) before posting it back.

Standard turnaround is 3-5 business days after the laboratory receives your sample. Turnaround does not begin until your sample is received and accepted by the laboratory.

If a sample cannot be analysed due to collection issues (insufficient blood, contamination, sample dried out during transit) we will contact you. The first re-collection is typically provided at no charge; subsequent re-collections may require a new purchase. See our Refund Policy for details.

9. Test results

Your test result will be made available to you through email and/or our customer account portal once analysis and quality review are complete. Results include:

  • Omega-3 Index
  • Omega-6:3 Ratio, AA:EPA Ratio, Trans Fat Index and 24 individual fatty acids (depending on the test purchased)
  • A plain-English interpretation referenced against established Australian and international clinical reference ranges
  • Your historical results if you have tested previously

Results are released only after laboratory quality control and review. If your result falls outside our validated reference ranges, it is reviewed by a qualified laboratory scientist before release.

You acknowledge that the report is for your personal information and you are responsible for sharing it with your GP or other healthcare provider if you wish them to consider it as part of your care. We do not communicate results directly to your healthcare provider unless you specifically authorise us to do so.

10. Health disclaimer and assumption of risk

By using the Service, you acknowledge and agree:

  • The Service measures specific fatty acids and reports those measurements against reference ranges; it does not replace clinical assessment, diagnosis, or treatment
  • You will not rely on the Service as the sole basis for any health decision
  • You will consult an appropriate healthcare professional before changing supplementation, medication, diet, or lifestyle in response to your test result
  • If you are pregnant, breastfeeding, immunocompromised, taking prescription medication, or have a chronic health condition, you will discuss your results with your healthcare provider before acting on them
  • You take the finger-prick blood sample yourself; we are not responsible for any minor bruising, discomfort, or infection that may result from the puncture (the lancet is sterile and single-use)

11. Australian Consumer Law and consumer guarantees

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Among other things, these include guarantees that goods are of acceptable quality, are fit for purpose, and match their description; and that services are provided with due care and skill and within a reasonable time.

Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantee, right, or remedy that you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

Your remedies for any major or minor failure of the Service are set out in our Refund Policy and in the Australian Consumer Law.

12. Limitation of liability

To the maximum extent permitted by law, and subject to our obligations under the Australian Consumer Law:

  • Our total aggregate liability to you in connection with the Service (whether in contract, tort, including negligence, statute, or otherwise) is limited to the price you paid for the relevant order
  • We are not liable for any indirect, consequential, special, incidental, or punitive damages, or for loss of profits, loss of business, or loss of opportunity
  • We are not liable for any health outcomes resulting from decisions you or any healthcare provider made based on your test result
  • We are not liable for delays or failures caused by events outside our reasonable control, including postal delays, internet outages, third-party service interruptions, public health emergencies, or natural disasters

This clause does not exclude or limit any liability that cannot lawfully be excluded or limited under the Australian Consumer Law or other applicable law.

13. Privacy and data handling

Our collection, use, storage, and disclosure of your personal and health information is governed by our Privacy Policy, which forms part of these Terms.

You acknowledge that:

  • Test results constitute "health information" and "sensitive information" under the Privacy Act 1988 (Cth)
  • You consent to such disclosure for the purposes of providing the Service, as further detailed in our Privacy Policy

14. Acceptable use of the Site

You agree not to:

  • Use the Site or Service for any unlawful purpose, or in any way that could damage, disable, or impair the Site
  • Attempt to gain unauthorised access to our systems, customer accounts, laboratory portal, or any related infrastructure
  • Misrepresent your identity or provide false information when ordering or registering a sample
  • Resell, redistribute, or commercially exploit test kits or results without our express written permission
  • Submit a sample from someone other than the named individual on the order without their informed consent
  • Use any automated means (bots, scrapers, crawlers) to access or interact with the Site, except for legitimate search engine indexing

15. Intellectual property

All content on the Site including text, images, design, logos, brand elements, the "Omega-3 Index Test" name, the methodology documentation, and the format of our reports is owned by us or our licensors and is protected by Australian and international intellectual property laws.

You may view, download, and print content from the Site for your own personal, non-commercial use. You may not reproduce, modify, distribute, or use any content for commercial purposes without our prior written permission.

Your test report, while based on our proprietary methodology and format, contains information about you and is yours to share with healthcare providers, retain in your personal health records, or otherwise use for your own purposes.

16. Marketing communications

We send marketing communications only with your express opt-in consent (for example, when you subscribe to our newsletter at checkout or via the website). Every marketing email contains a clear unsubscribe link. Transactional emails (order confirmations, shipping updates, result notifications) are not marketing and will be sent regardless of marketing preferences.

17. Account suspension and termination

We may suspend or terminate your access to the Service if we reasonably believe you have breached these Terms, provided false information, attempted to defraud us, or engaged in conduct that is harmful to us, other customers, or our service providers. Where reasonably possible, we will notify you and provide an opportunity to address the issue before terminating access.

You may close your account at any time by contacting us. Closure of your account does not entitle you to a refund of past orders unless eligible under our Refund Policy or the Australian Consumer Law. We will retain your test history for the period required by health records legislation (typically 7 years), as set out in our Privacy Policy.

18. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email (if you have an account) and by prominent notice on the Site. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. The "Last updated" date at the top of these Terms will always reflect the most recent revision.

19. Governing law and jurisdiction

These Terms are governed by the laws of Victoria, Australia. Any dispute arising from or in connection with these Terms or the Service is subject to the exclusive jurisdiction of the courts of Victoria.

20. Severability and waiver

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any provision at any time does not constitute a waiver of that provision or any other.

21. Entire agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements or understandings.
